DEDICATED SERVER SERVICE GENERAL PROVISIONS

ARTICLE 1: APPLICATION AND PERFECTION INTEREST OF THE CTN1 HOSTING GENERAL PROVISIONS
These general provisions are exercisable to any hosting service providing for a dedicated Internet server to the Customer. Consequently, placing an order implies the entire and without any reserve compliance of the customer with these service providing general provisions. No particular provision can, except upon CTN1's formal and written acceptance prevail over these general provisions. Any opposing clause proposed by the Customer will thus be, for lack of any express acceptation ineffective against CTN1, no matter when this can be brought to latter's attention. The fact that CTN1 does not exercise at a certain time its rights over any of these general provisions and/or tolerates an infringement by the other Party of any of the liabilities mentioned in these general provisions cannot be interpreted as a waiver by CTN1 to prevail subsequently over any of the above mentioned provisions.
ARTICLE 2: OBJECT
The object of these general provisions is to define the technical and financial conditions under which CTN1 undertakes to host on its server platform the Customer's Internet dedicated server. The Customer admits explicitly that CTN1 does not participate in any way as stated in these provisions to the design, development or the construction of the Customer's website and of the management and administration computer tools.
ARTICLE 3: MEANS
CTN1's server platform is accessible to the general public by the Internet network by means of stations connected to the Internet network. During the entire period of the Customer's dedicated server hosting, CTN1 places at the Customer's disposal the access to the reserved support website, thanks to which the Customer will be able to take advantage of the technical support.
ARTICLE 4: TECHNICAL SUPPORT
CTN1 places at the Customer's disposal a technical assistance:
On the Internet at https://CTN1.net/support or by phone: 01 30 16 45 60, Monday to Friday, from 9 a.m. to 7 p.m. The technical support is only cut out for providing a punctual help to the Customer. It is not meant to provide an intervention on the Customer's computer/server. Any such remote intervention will be subject to specific service providing. For this, the Customer must contact by e-mail the sales department at in order to settle beforehand a specification of the intervention. Once the specification is accepted by the Customer, and on receipt of the payment, shall the intervention start.
ARTICLE 5: SERVICE PROVIDING IMPLEMENTATION AND BILLING CONDITIONS
CTN1 undertakes to rent and host a dedicated server to the Customer on its server platform on reception of the order form e-mailed by the Customer on the ctn1.net website, the corresponding payment and upon acceptance of the general terms of sale approved by the Customer. CTN1 will acknowledge receipt to the Customer of the order form, of the payment and of the contract, and will inform him/her by e-mail of the placing at the Customer's disposal of the dedicated server. For lack of sending this acknowledgement of receipt by e-mail, the agreement cannot be considered as concluded. The actual on-lining of the dedicated server determines the initial date to which the invoice will be due. For any data transfer by e-mail, the date and time of the CTN1 server will be evidence to the Parties. This data will be stored by CTN1 for all the contract relations period, added to the period of any action brought into Court.
ARTICLE 6: OPERATING PROVISIONS
CTN1 undertakes to put everything to use in order to guarantee the permanence, the continuity and the quality of the proposed services, and subscribes as such to a means liability; consequently, CTN1 will do its best to offer a 24/7 Internet access. The Customer admits by this Agreement that bandwidth fluctuations and the risks incurred by the access provider are elements that could lead to an server access discontinuity beyond CTN1's control and exterior to its technical means as stated in article 9.
ARTICLE 7: CUSTOMER DATA AND SERVICE COMPLIANCE
The Customer admits having checked for the conformity of the service with his/her needs and having received from CTN1 all of the information and advice needed in order to subscribe to this Agreement with full knowledge of the facts.
